Hillary'sHome cares deeply about your privacy. Therefore, we process only the data we need for (improving) our services and handle the information we collect about you and your use of our services carefully. We never provide your data for commercial purposes to third parties. This privacy policy applies to the use of the website and the services provided by Hillary'sHome. The effective date for the validity of these terms is 01/04/2023. With the publication of a new version, the validity of all previous versions expires. This privacy policy describes what data we collect about you, how we use this data, and with whom and under what conditions this data may possibly be shared with third parties. We also explain how we store your data and how we protect your data against misuse and what rights you have regarding the personal data you provide to us.

Data Processing

Below you can read how we process your data, where we store it (or have it stored), what security techniques we use, and who has access to the data.

Webshop Software

Shopify

Our webshop is developed with software from and hosted on Shopify. Personal data that you provide to us for our services is shared with this party. Nxtlvl has access to your data to provide us with technical support; they will never use your data for any other purpose. Based on the agreement we have concluded with them, Nxtlvl is obliged to take appropriate security measures. These security measures include the application of SSL encryption and a strong password policy. Regular backups are made to prevent data loss.

Email and Mailing Lists

MailChimp

We send our email newsletters with MailChimp. MailChimp will never use your name and email address for its own purposes. At the bottom of each email sent automatically via our website, you will find the 'unsubscribe' link. You will no longer receive our newsletter. Your personal data is securely stored by MailChimp. MailChimp uses cookies and other internet technologies that provide insight into whether emails are opened and read. MailChimp reserves the right to use your data to further improve its services and to share information with third parties in this context.

Dieter van Giesbergen

For our regular business email traffic, we use the services of Dieter van Giesbergen. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. Dieter van Giesbergen only has access to our mailbox if there is a necessary (technical) reason for it. We handle all our email traffic confidentially.

Payment Processors

Mollie

To handle (part of) the payments in our webshop, we use the Mollie platform. Mollie processes your name, address, and residence details and your payment details such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to improve its services further and to share (anonymized) data with third parties in that context. In the case of a request for a deferred payment (credit facility), Mollie will share personal data and information regarding your financial position with credit rating agencies. All the aforementioned safeguards with regard to the protection of your personal data also apply to the parts of Mollie's services for which they engage third parties. Mollie does not store your data for longer than is allowed on the basis of the statutory deadlines.

Shipping and Logistics

Sendcloud

When you place an order with us, it is our job to have your package delivered to you. We use the services of Sendcloud to carry out the deliveries. It is therefore necessary to share your name, address, and residence details with Sendcloud. Sendcloud uses this data only for the purpose of executing the agreement. In the event that Sendcloud engages subcontractors, Sendcloud also makes your data available to these parties.

Purpose of Data Processing:

General Purpose of the Processing

We use your data exclusively for our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later date – unlike your request – we will ask you for explicit permission to do so. Your data will not be shared with third parties, except for fulfilling accounting and other administrative obligations. These third parties are all held to confidentiality based on the agreement between them and us or an oath or legal obligation.

Automatically Collected Data

Data automatically collected by our website is processed with the aim of improving our services further. This data (e.g., your IP address, web browser, and operating system) are not personal data.

Participation in Fiscal and Criminal Investigations

In certain cases, on the basis of a legal obligation, Hillary'sHome may be required to share your data in connection with tax or criminal investigations conducted by the government. In such a case, we are forced to share your data, but we will oppose this within the possibilities offered by the law.

Retention Periods:

We store your data for as long as you are a client of ours. This means that we keep your customer profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also consider this as a request for forgetting. Based on applicable administrative obligations, we must keep invoices with your (personal) data, so we will keep this data for as long as the applicable term runs. However, employees no longer have access to your customer profile and documents we have created based on your order.

Your Rights:

On the basis of the applicable Dutch and European legislation, you, as a data subject, have certain rights regarding the personal data processed by or on behalf of us. We explain to you below which rights these are and how you can invoke these rights.

In principle, we send copies and copies of your data only to your already known email address to prevent abuse. If your request is granted, we will send you a confirmation to the email address known to us that the data has been adjusted.

Right to Limitation of Processing:

You always have the right to limit the data we process that relate to your person or that can be traced back to you. You can make a request with that effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address known to us that the data will no longer be processed until you lift the restriction.

Right to Data Portability:

You always have the right to have the data we process that relate to your person or that can be traced back to you carried out by another party. You can make a request with that effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send you copies or copies of all data about you that we have processed or that have been processed on our behalf by other processors or third parties. In all likelihood, we can no longer continue the service in such a case because the secure linking of databases can then no longer be guaranteed.

Right to Object and Other Rights:

In certain cases, you have the right to object to the processing of your personal data by or on behalf of Hillary'sHome. Cookies are placed on our website by the American company Google as part of the "Analytics" service. We use this service to keep track of and receive reports on how visitors use the website. This processor may be obliged under applicable laws and regulations to provide insight into this data. We have not allowed Google to use the analytics information obtained for other Google services.

Changes to the Privacy Policy:

We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy has consequences for the way we process data already collected about you, we will notify you of this by email.
